The Court, having considered the foregoing petition and having heard the Advocate Depute, the first respondent personally, counsel for the second respondent and the solicitor advocate for the third respondent; appointed a hearing to be fixed in respect of the Lord Advocate’s reference and to be set down for five days; appoints all parties to lodge skeletal arguments one week before the date fixed for the hearing; in respect there has been no intimation from the first respondent in terms of Section 123(2)(b) of the Criminal Procedure (Scotland) Act 1995 appointed G.J.B.Moynihan Q.C. to act as amicus curiae; Ordered that the evidence of the witnesses Francis Boyle, Paul Rogers and Rebecca Johnson given at the trial be transcribed; Required the Sheriff to prepare a report relative to the issues raised in the Lord Advocate’s reference setting out her reasons for her decisions; Directed the Crown to lodge with the Justiciary copies of the transcripts already obtained for use in the Court; Refused the motion of counsel for the second respondent to remit all issues of fact and international law arising from Question 2 in the Lord Advocate’s reference to one of its number; refused the motion of counsel for the second respondent to refer a question of law to the European Court of Justice; refused the motion of counsel for the second respondent to record all proceedings at the hearing and made no order in respect of expenses for the first respondent.
